Terms of Sales

The present general conditions of sale concern the sale of the products listed on the online store, accessible on the WWW.LETRAITEUR.CA website. The confirmation of the order entered online assumes that the customer has the full legal capacity to contract, and wins its acceptance without reservation to these Terms and Conditions. 

1. Product information:

Each Product offered on the site is the subject of a presentation indicating its name, composition and price.

The photographs and information of the products presented on the site are not contractual. In case of discrepancies between these photographs and information and the product (s) chosen by the customer LE TRAITEUR.CA cannot be held responsible.

LE TRAITEUR.CA reserves the right to modify the composition of the menus according to the hazards related to the supply of products and / or under the principle of precaution.


2. Order processing

2.1 on line Order (Manager page Ueat)

Throughout the first order, a username will be proposed by LETRAITEUR.CA and a password will be chosen by the customer. The username and password are proof of the customer’s identity and are binding on any order placed by him.

The customer is solely responsible for his username and password and will bear alone the consequences that may result from any use by third parties who would have known of them, unless he demonstrates that the knowledge of this identifier and of this password results from a fault of LE TRAITEUR.CA.

In the event of forgetfulness of his password or his identifier, the customer has on the site a function allowing him to find his ID and choose a new password.

2.2 Orders

All orders must be validated and confirmed by the customer. The confirmation implies acceptance of the transaction and closes the sale. LE TRAITEUR.CA will communicate to the customer, by e-mail, a confirmation of the recorded order.

2.3 Order preparation time

In order to respect the deadlines, the customer agrees to carry out his order 24 hours in advance on weekdays and 48 hours during the weekend so that LE TRAITEUR.CA can deliver the said order on the scheduled date.


3. Modification – Cancellation– Retractions

3.1 Modification – Cancellation

Orders are firm, final and not subject to change or cancellation from the 72 hours preceding the day of delivery.

For any order 50 peoples or more, any order with special demand or material reservation,  Orders are firm, final and not subject to change or cancellation from the 2 weeks preceding the day of delivery.

Any modification or cancellation must be made within the above mentioned deadlines, by contacting directly LE TRAITEUR.CA at 514-862-2822, from Monday to Friday, from 9h to 18h.


4. Stock shortage

LE TRAITEUR.CA cannot guarantee at any time the availability of each product offered on the site. Thus, in case of stock shortage of an item ordered, LE TRAITEUR.CA will contact the customer by email or phone as soon as possible to inform and agree with him:
-Postpone the delivery while waiting for the replenishment of this product, when possible.
-To replace the product with another equivalent in quality and price.
-Deliver the order and refund the price possibly paid.


5. Price and payment conditions

The orders amount is payable by credit card, directly on the site.
No discount can be granted. Any unpaid amounts by the due date will, automatically and without prior notice, be subject to late payment penalties at a rate equal to one and a half times the legal interest rate, to which will be added the payment of the inherent costs in this delay. In case of late payment, LE TRAITEUR.CA will suspend all current orders without prejudice to any other course of action.

The emailing of an invoice is automatic to the billing details provided by the customer.

5.1 Prices

The total amount to be paid by the customer includes the price of products and delivery charges. Prices are in Canadian dollars. The applicable QST and GST rates are those in effect on the day of the order.
The prices posted on the sites are likely to be revised according to the price of the seasonal products and the economic conditions.

5.2 Terms of payment

Regardless of the method of payment, payments are in Canadian dollars. Customers natural persons as well as customers legal entities must pay the amount of their order online by credit card or Paypal, under the conditions detailed below.

Online payment by credit card
The customer must indicate the number and validity date of his card (American Express, VISA).
Payments made online by credit card will be made through the Paypal service, so that the information transmitted is encrypted by software and no third party can be aware during transport on the network.
The customer agrees to be charged the full amount due at the time of the order. The customer agrees to personally use the credit card he holds. In case of fraudulent use, LE TRAITEUR.CA cannot be held liable. In the absence of a bank provision, the order will be automatically canceled.


6. Delivery

In case of delay of more than four hour on the delivery schedule provided in the order form, the delivery cost will be borne by LE TRAITEUR.CA, unless this delay is due to incorrect address details by the customer. The products will be delivered to the customer against signature of the delivery note, mentioning the time of delivery.

The delivery charges are billed to the customer in accordance with the rate of deliveries in effect on the Online Shop, established by list of postal codes.

In case of absence of the customer during the delivery of the order, it will be returned to the LE TRAITEUR.CA by the carrier.

The customer cannot claim any refund.


7. Claims

The customer will have to make sure of the conformity of the delivery with his order. Any claim must, to be taken into account, intervene at the time of delivery. In case of non-compliance or defect of the delivered products or missing products, the customer will have to report precise reservations, dated and signed on the delivery note. In this case, the customer will be able to obtain the free replacement or the return of a credit for his profit, to the exclusion of all other indemnity or damages and interests. For reasons of hygiene and food safety, perishable goods will not be taken back or exchanged.

Any dispute concerning invoicing can only be taken into account within 8 days from the date of receipt of the invoice.

8. Responsibility

Without proof of error on its part, LE TRAITEUR.CA cannot be held responsible for any damage that may result from the use of the Internet, such as, such as data loss, intrusion, virus, suspension of service, fraudulent use of credit card.

Furthermore, LE TRAITEUR.CA cannot be held liable for any direct or indirect damage caused by the fault of the customer, including the consumption of products beyond the deadline indicated on their packaging.


9. Major force

LE TRAITEUR.CA could be released from its obligations or suspend the execution if it were unable to assume them following a case of force majeure (war, riot, demonstrations, exceptional climatic conditions, disaster affecting the facilities of its establishments …), without this giving rise to any compensation.


10. Protection of personal information

The information collected on the site will be subject to computer processing. They are intended for LE TRAITEUR.CA, for purposes of management and processing of orders as well as commercial prospection.

11. Modifications

LE TRAITEUR.CA reserves the right to modify its Terms and Conditions at any time. In this case, the applicable conditions will be those in force on the date of the order by the customer.


13. Applicable law – Disputes

These General terms and Conditions of Sale and all transactions referred to therein are subject to Canadian law. In case of dispute, the customer will contact LE TRAITEUR.CA to find an amicable solution. Otherwise, the case will be brought before the competent courts of Montreal.


14. Copyrights

The texts, photographs, images and logos appearing on the site are property of LE TRAITEUR.CA. Any reproduction, even partial, is subject to authorization.
